These Terms & Conditions ("Terms") govern your use of services provided by Euphorya Design ("we", "us", or "our") via euphoryadesign.com. By engaging our services, placing an order, or making a payment, you ("Client") agree to be bound by these Terms. Please read them carefully before proceeding.

1. Scope of Services

Euphorya Design provides the following categories of design and web services:

  • Canva Design Subscriptions — ongoing monthly design services including social media graphics, flyers, menus, presentation decks, and other visual assets delivered as editable Canva files
  • Canva Design Projects — one-time, fixed-scope design deliverables quoted per project
  • WordPress Care Plans — monthly website maintenance including plugin/theme updates, security monitoring, and backups
  • WordPress Website Projects — custom website design and development including landing pages, corporate sites, and WooCommerce stores

The specific scope, deliverables, and inclusions for each engagement are defined at the time of purchase or as outlined in a written proposal or invoice. Services not explicitly stated in the agreed scope are not included unless separately quoted and agreed in writing.

2. Quotes & Pricing

All prices displayed on our website are in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice; however, any change will not affect an order that has already been placed and confirmed.

Subscription Plans

Monthly subscription pricing is fixed for the duration of each billing cycle. Any price changes will be communicated at least 14 days prior to the next renewal date.

One-Time Projects

Project quotes are valid for 14 days from the date of issue. A written quote or invoice constitutes the agreed price for the defined scope. Additional work requested beyond the agreed scope will be quoted separately before work commences.

Custom Quotes

For larger WordPress projects or enterprise requirements, a custom proposal will be provided following a discovery call. Work will not commence until the quote is accepted in writing and a deposit is received.

3. Payment Terms

Subscriptions

Subscription plans are billed monthly in advance on the date of your initial payment. Payments are processed automatically via Stripe. Your subscription remains active until cancelled in accordance with our Cancellation Policy.

One-Time Projects

One-time design projects require full payment upfront before work commences. For larger projects (above USD 500), we may require a 50% deposit before work begins, with the balance due prior to final file delivery.

WordPress Projects

WordPress website projects require a 50% deposit to confirm your booking and begin the project. The remaining 50% is due upon project completion, before the website is transferred to your hosting or made live.

Late Payments

If a payment fails or is not received by the due date, we reserve the right to pause or suspend active work until the outstanding amount is settled. For projects, we reserve the right to withhold final deliverables until full payment is received.

All payments are processed securely via Stripe. We do not store your payment card details. Please refer to Stripe's Privacy Policy for details on how payment data is handled.

4. Project Timelines

Design Subscriptions

Active design requests are typically delivered within 48–72 hours (business days) of submission. Timelines may vary depending on the complexity of the request, the volume of active tasks, and the completeness of the brief provided.

One-Time Design Projects

Turnaround times for one-time projects are confirmed at the time of engagement and are contingent on timely receipt of all required assets and feedback from the Client.

WordPress Projects

Estimated timelines for WordPress website projects are provided in the project proposal. These timelines assume prompt Client feedback and asset delivery. Delays caused by the Client — including delayed content, feedback, or approvals — may extend the project timeline accordingly. We are not liable for delays arising from Client-side inaction.

5. Revision Policy

Design Subscriptions

Subscription clients receive unlimited revisions within the agreed scope of each task. Revisions must be requested within 7 days of delivery. A revision is defined as a modification to an existing deliverable. A substantially new design direction or a new task counts as a separate task against the monthly allowance.

One-Time Design Projects

One-time project quotes include a defined number of revision rounds as stated in the proposal (typically 2 rounds). Additional revisions beyond the included rounds will be charged at an agreed hourly rate.

WordPress Projects

WordPress project proposals include a defined scope of revisions during the build phase. Post-launch edits and changes are not included unless covered by an active WordPress Care Plan or separately quoted.

Revision requests must be submitted in writing (via WhatsApp, email, or the agreed communication channel) with clear, consolidated feedback. Revisions are based on the original approved brief and do not include scope changes.

6. Ownership & Intellectual Property

Final Deliverables

Upon receipt of full payment, the Client is granted full ownership of the final deliverables produced for their project. This includes Canva design files (where applicable), exported graphics, and completed websites.

Working Files & Source Assets

Preliminary concepts, draft files, and working documents remain the property of Euphorya Design unless explicitly included in the agreed scope and confirmed in writing.

Third-Party Assets

Designs may incorporate third-party elements (stock images, fonts, icons, Canva premium elements) that are licensed but not exclusively owned. The Client is responsible for ensuring that any assets they provide to us are legally licensed for commercial use. We are not liable for any intellectual property infringement arising from Client-supplied materials.

Portfolio Rights

We reserve the right to display completed work in our portfolio, website, and social media channels unless the Client explicitly requests confidentiality in writing prior to project commencement.

7. Client Responsibilities

To ensure a smooth and timely project, the Client agrees to:

  • Provide complete, accurate, and timely briefs, assets, and feedback as required
  • Ensure that all materials provided (logos, images, copy, etc.) are owned by the Client or are appropriately licensed for use
  • Nominate a single point of contact for project communications to avoid conflicting instructions
  • Respond to requests for feedback or approvals within a reasonable timeframe (typically 3–5 business days)
  • Ensure their Canva account is accessible and in good standing for receiving shared design files
  • Ensure their WordPress hosting, domain, and admin credentials are accessible where required for website or care plan services

Euphorya Design is not responsible for delays or outcomes resulting from the Client's failure to fulfil these responsibilities.

8. Cancellation Policy

Subscriptions

Subscription plans may be cancelled at any time before the next billing date. Cancellations must be requested in writing via WhatsApp or email. Access to services and deliverables continues until the end of the current billing period. No partial refunds are issued for unused days within a billing cycle.

We also offer a pause option for subscriptions. Clients may pause their subscription for up to 30 days per calendar year by notifying us in writing. The billing cycle will resume upon reactivation.

One-Time Projects

If a Client cancels a one-time project after payment and before work has commenced, a full refund may be issued. If work has commenced, the Client will be charged for the proportion of work completed, and the remaining balance will be refunded.

WordPress Projects

If a Client cancels a WordPress project after the deposit has been paid and work has commenced, the deposit is non-refundable. Any work completed up to the point of cancellation will be invoiced at the agreed project rate.

9. Refund Policy

Due to the nature of creative and digital services, we generally do not offer refunds once work has been delivered. However, we are committed to ensuring client satisfaction. If you are not satisfied with a deliverable, we will work with you to resolve the issue through our revision process.

A refund may be considered in the following circumstances:

  • The agreed service was not delivered within a substantially reasonable timeframe due to our error
  • The delivered work materially fails to meet the agreed brief with no satisfactory resolution achievable through revisions
  • A duplicate charge was made in error

Refund requests must be submitted in writing within 7 days of delivery. We reserve the right to assess each request on a case-by-case basis. Approved refunds will be processed via the original payment method within 7–14 business days.

We do not offer refunds for subscription fees already billed, change-of-mind cancellations after work has commenced, or dissatisfaction with design direction not aligned with the original approved brief.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Euphorya Design shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from the use of our services
  • Loss of revenue, profits, business opportunities, or data resulting from service interruptions or deliverable outcomes
  • Errors or omissions in content provided by the Client and incorporated into designs or websites
  • Third-party platform outages, changes, or discontinuations (including Canva, WordPress, or hosting providers)
  • Security breaches arising from Client-side vulnerabilities or third-party hosting environments

Our total liability to the Client for any claim arising out of or relating to these Terms shall not exceed the total fees paid by the Client to Euphorya Design in the three months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Governing Law (Singapore)

These Terms and Conditions are governed by and construed in accordance with the laws of Singapore. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

We reserve the right to amend these Terms at any time. Changes will be published on this page with an updated revision date. Continued use of our services after changes constitutes your acceptance of the updated Terms.
